One of the first questions people ask when they’re thinking about divorce is, “How long is this going to take?”
And it’s a reasonable question. When you’re considering a major life change, you want to know when you’ll be able to move forward.
In North Carolina, you generally have to live separate and apart for at least one year before you can file for an absolute divorce. That means living in separate residences, with at least one spouse intending for the separation to be permanent. Sleeping in separate bedrooms under the same roof doesn’t count.
But here’s what a lot of people don’t realize: You don’t have to wait until that year is over to figure out who gets the house, how you’ll divide your money and debts, or what custody and support arrangements will look like. You can start making those decisions during your separation, so you may have much of the work behind you by the time you’re eligible to legally divorce.
How Long Does Divorce Actually Take in North Carolina?
What Can You Do During the Separation Year?
Quite a lot, actually.
While you’re waiting to become eligible for an absolute divorce, you can begin addressing many of the decisions that often take the most time, including:
- Property and finances: What happens to your home, retirement accounts, investments, debts, and other assets?
- Child custody and support: What will parenting schedules and financial responsibilities look like?
- Alimony: Will either spouse need financial support, and what might that look like?
- Separation agreements: Can you and your spouse reach agreements on important issues before the divorce is final?
In some cases, couples can resolve many of these issues during the separation year. In others, disagreements, complicated finances, or custody concerns can make the process take longer.
And while the one-year separation requirement is generally fixed, how you use that time can make a real difference.
So, How Long Will Your Divorce Take?
That depends on more than the calendar.
Your timeline will be affected by how complicated your situation is, whether you and your spouse can reach agreements, and whether court involvement becomes necessary.
There’s also an important distinction between getting legally divorced and resolving everything that comes with it. An absolute divorce ends your marriage, but it doesn’t automatically settle your property, support, or custody issues. Certain financial claims can even be lost if they aren’t properly protected before the divorce judgment.
That’s why we encourage people to understand their options early, even if they aren’t ready to make every decision just yet.
Waiting to Get Answers Can Mean Waiting Even Longer
We get it. If you’re worried that divorce is going to take months or even years, it’s tempting to put off dealing with it altogether.
But waiting because you don’t know how long the process will take doesn’t make that timeline any shorter. In fact, it can push things further down the road.
The sooner you understand what needs to happen, the sooner you can start making a plan. That doesn’t mean you have to file anything, move out, or make a decision about your marriage today.
It just means you can stop guessing about the timeline and start understanding what it could actually look like for you.
You Don’t Have to Wait to Start Planning.
Maybe you’re already separated. Maybe you’re thinking about it but aren’t sure when or how to start.
Either way, you don’t need to have everything figured out before talking with an attorney.
At Triangle Smart Divorce, we’ll help you understand what your timeline may look like, which decisions need attention now, and what steps you can take to prepare.
You may have to wait a year to legally end your marriage. You don’t have to wait a year to start figuring out your future.
